Bu Kullanım Şartları ("Şartlar"), Onur Ökten ("biz" veya "hizmet sağlayıcı") tarafından sunulan Arkanda! uygulamasının (https://arkanda.app) kullanımına ilişkin koşulları belirler.
Arkanda'yı kullanarak bu Şartları okuduğunuzu, anladığınızı ve kabul ettiğinizi beyan edersiniz. Şartları kabul etmiyorsanız uygulamayı kullanmayınız.
Bu Şartlarda Hizmet, Arkanda! mutfak yönetim platformunu; Kullanıcı veya Siz, Hizmeti kullanan birey veya işletmeyi; Hesap, Hizmette kullanıcıya ait kaydı; İçerik ise kullanıcı tarafından oluşturulan reçete, menü, restoran bilgisi ve benzeri verileri ifade eder.
Arkanda!, profesyonel mutfaklar için tasarlanmış bir yönetim platformudur. Reçete ve menü yönetimi, maliyet ve fiyatlandırma hesaplaması, restoran ve şube yönetimi, ekip ve rol bazlı yetkilendirme, vardiya ve operasyon takibi gibi özellikler sunar.
Hizmet "olduğu gibi" sunulur. Özellikler zaman zaman değişebilir, eklenebilir veya kaldırılabilir.
Hesap oluşturmak için 18 yaşından büyük olmalısınız. Doğru ve güncel bilgi vermelisiniz. Hesabınızın güvenliğinden ve şifrenizin gizliliğinden siz sorumlusunuz. Hesabınızı başkalarıyla paylaşamazsınız; ekip üyelerini ayrı ayrı davet etmeniz gerekir.
Hizmeti yasadışı faaliyetler, sahte veya yanıltıcı bilgi paylaşımı, başkalarının haklarını ihlal etmek, sistemi manipüle etmek veya saldırmak (DDoS, scraping vb.), yetkisiz erişim girişimleri, spam veya istenmeyen mesaj gönderimi, ya da Hizmeti tersine mühendislik yapmak veya kopyalamak için kullanamazsınız. Bu kuralları ihlal eden hesaplar uyarı olmaksızın askıya alınabilir veya silinebilir.
Şu anda Arkanda! tamamen ücretsiz olarak sunulmaktadır. Henüz ödeme entegrasyonu bulunmamaktadır.
İleride premium tier'lar eklenebilir. Bu durumda mevcut ücretsiz kullanıcılara 30 gün önceden bildirim yapılır. Premium özellikler, free tier özelliklerini ortadan kaldırmaz. Fiyatlar bu sayfada veya ayrı bir "Fiyatlandırma" sayfasında ilan edilir.
Hizmette oluşturduğunuz tüm İçeriğin (reçete, menü, restoran bilgileri ve benzerleri) sahibi sizsiniz. Biz sadece bu İçeriği size sunmak ve saklamak için sınırlı bir lisansa sahibiz.
Oluşturduğunuz İçerikten siz sorumlusunuz. İçeriğin yasalara uygun olmasını, üçüncü taraf haklarını ihlal etmemesini ve doğru ve güncel olmasını sağlamak sizin yükümlülüğünüzdür.
Hizmet aracılığıyla oluşturduğunuz İçerik reklamda kullanılmaz, satılmaz veya devredilmez, yapay zeka modeli eğitiminde kullanılmaz ve paylaşım özelliği hariç başka kullanıcılara size sormadan gösterilmez. Hizmeti çalıştırmak için gerekli olan teknik işlemler (yedekleme, performans iyileştirme ve benzerleri) bu kapsamın dışındadır.
Hizmet 7/24 erişilebilir olmaya çalışır, ancak bakım, güncelleme veya altyapı sorunları nedeniyle kesintiler yaşanabilir. Üçüncü taraf hizmet sağlayıcılarının (Supabase, Vercel) kesintilerinden etkilenebiliriz. Önemli kesintiler için bildirimde bulunmaya çalışırız ancak bunu garanti etmeyiz.
Hizmet otomatik yedekleme yapsa da, kritik İçeriğinizi periyodik olarak dışa aktarmanızı öneririz.
Hesabınızı istediğiniz zaman silebilirsiniz. Uygulamada Ayarlar, Hesabı Sil yolunu izleyebilir veya info@arkanda.kitchen ile iletişime geçebilirsiniz. Hesap silme talebinden sonra verileriniz 30 gün içinde kalıcı olarak silinir (Gizlilik Politikası md. 7'ye bakınız).
Aşağıdaki durumlarda hesabınızı askıya alabilir veya silebiliriz: bu Şartların ciddi ihlali, yasal yükümlülükler (mahkeme kararı ve benzerleri), Hizmete zarar verme veya kötüye kullanım, ya da 12 ay aktif olmama (önceden bildirim ile). Hesabınız silinmeden önce mümkün olduğunda bildirimde bulunur ve verilerinizi dışa aktarma fırsatı sunarız.
Hizmet "olduğu gibi" ve "mevcut olduğu kadar" sunulmaktadır. Yürürlükteki yasaların izin verdiği azami ölçüde Hizmetin kesintisiz çalışacağını, ihtiyaçlarınıza uygun olacağını veya hatalarının düzeltileceğini garanti etmiyoruz. Üçüncü taraf entegrasyonlarının (Google, Supabase ve benzerleri) sürekli çalışacağını garanti etmiyoruz.
Yürürlükteki yasaların izin verdiği azami ölçüde, herhangi bir nedenden kaynaklanan tüm zararlar için toplam sorumluluğumuz, son 12 ayda Hizmet için bize ödediğiniz tutarla sınırlıdır. Hizmet ücretsizse bu tutar sıfırdır.
Veri kaybı (kendi yedekleme önerimize rağmen), kâr kaybı, iş kesintisi, dolaylı, sonuç olarak ortaya çıkan veya cezai zararlardan sorumlu olmayacağız. Bu sınırlamalar, kasıt veya ağır ihmal halinde uygulanmaz.
Hizmet üçüncü taraf altyapısı kullanır (Gizlilik Politikası md. 4'e bakınız): Supabase (veritabanı, kimlik doğrulama), Vercel (hosting), Google (OAuth) ve hCaptcha (bot koruması). Bu üçüncü tarafların kendi şartları ve gizlilik politikaları uygulanır. Onların hizmetlerinden kaynaklanan sorunlardan sorumlu değiliz.
Arkanda! markası, logosu, kodu, tasarımı ve tüm fikri mülkiyet hakları bize aittir. İzinsiz kopyalanamaz, dağıtılamaz veya türetilmiş eserlerde kullanılamaz.
Hizmet hakkında bize gönderdiğiniz öneriler, geri bildirimler veya fikirler, herhangi bir telif hakkı veya sınırlama olmaksızın bizim tarafımızdan kullanılabilir.
Bu Şartları zaman zaman güncelleyebiliriz. Önemli değişiklikler uygulama içinde bildirimle gösterilir, kayıtlı kullanıcılara email yoluyla bildirilir ve "Son güncelleme" tarihi yenilenir. Önemli değişiklikler için 30 gün önceden bildirim verilir. Değişiklikleri kabul etmiyorsanız, etkili olmadan önce hesabınızı silebilirsiniz.
Bu Şartlardan kaynaklı bir uyuşmazlık olursa, önce iyi niyetle uzlaşmaya çalışmamızı umuyoruz. info@arkanda.kitchen ile iletişime geçin.
Uzlaşma sağlanamazsa Türkiye merkezli kullanıcılar için İstanbul Mahkemeleri ve İcra Daireleri yetkilidir. Tüketici niteliğindeki uyuşmazlıklar için Tüketici Hakem Heyetleri ve Tüketici Mahkemeleri'nin yetkisi saklıdır. Diğer ülkelerdeki kullanıcılar için uygulanacak hukuk Türkiye hukukudur, ancak yerel zorunlu tüketici koruma hükümleri saklıdır.
Bu Şartlar, Hizmet kullanımına ilişkin tüm anlaşmayı oluşturur ve önceki tüm şart ve anlaşmaları geçersiz kılar. Bu Şartların herhangi bir hükmü geçersiz veya uygulanamaz bulunursa, geri kalan hükümler geçerliliğini korur. Bir hakkın kullanılmaması veya geç kullanılması, o hakkın feragati anlamına gelmez.

These Terms of Service ("Terms") govern the use of the Arkanda! application (https://arkanda.app) provided by Onur Ökten ("we" or "service provider").
By using Arkanda, you confirm that you have read, understood and agree to these Terms. If you do not agree, please do not use the application.
In these Terms, Service refers to the Arkanda! kitchen management platform; User or You refers to the individual or business using the Service; Account refers to the user's registration in the Service; Content refers to recipes, menus, restaurant information and other data created by users.
Arkanda! is a management platform designed for professional kitchens. It includes recipe and menu management, cost and pricing calculations, restaurant and branch management, team management with role-based permissions, and shift and operations tracking.
The Service is provided "as is". Features may change, be added or removed over time.
To create an account you must be at least 18 years old. You must provide accurate and current information. You are responsible for maintaining the confidentiality of your password and account security. You may not share your account with others; invite team members separately.
You may not use the Service for illegal activities, sharing false or misleading information, violating others' rights, manipulating, attacking or damaging the system (DDoS, scraping, etc.), unauthorized access attempts, sending spam or unsolicited messages, or reverse engineering or copying the Service. Accounts violating these rules may be suspended or deleted without prior notice.
Arkanda! is currently provided completely free of charge. There is no payment integration at this time.
Premium tiers may be introduced in the future. In that case existing free users will receive 30 days' advance notice. Premium features will not remove existing free tier features. Pricing will be published on this page or a separate "Pricing" page.
You own all Content you create in the Service (recipes, menus, restaurant information and similar). We hold only a limited license to display and store this Content for you.
You are responsible for the Content you create. You must ensure that your Content complies with applicable laws, does not infringe third-party rights and is accurate and up-to-date.
The Content you create through the Service is not used for advertising, is not sold or transferred, is not used to train AI models and is not shown to other users without your consent (except via sharing features). This excludes technical operations necessary to run the Service (backups, performance optimization and similar).
The Service strives to be accessible 24/7, but interruptions may occur due to maintenance, updates or infrastructure issues. We may be affected by outages from third-party providers (Supabase, Vercel). We strive to provide notice of significant interruptions but we do not guarantee this.
Although the Service performs automatic backups, we recommend periodically exporting critical Content yourself.
You may delete your account at any time. Use Settings, Delete Account in the application or contact info@arkanda.kitchen. After a deletion request, your data is permanently deleted within 30 days (see Privacy Policy section 7).
We may suspend or delete your account in cases of: material breach of these Terms, legal obligations (court order and similar), harm to the Service or abuse, or 12 months of inactivity (with prior notice). We will provide notice when possible and offer the opportunity to export your data.
The Service is provided "as is" and "as available". To the maximum extent permitted by applicable law, we do not guarantee that the Service will operate uninterrupted, will meet your needs or that errors will be corrected. We do not guarantee continuous operation of third-party integrations (Google, Supabase and similar).
To the maximum extent permitted by applicable law, our total liability for all damages from any cause is limited to the amount you paid us for the Service in the past 12 months. If the Service is free, this amount is zero.
We will not be liable for data loss (despite our backup recommendations), loss of profits, business interruption, or indirect, consequential or punitive damages. These limitations do not apply in cases of willful misconduct or gross negligence.
The Service uses third-party infrastructure (see Privacy Policy section 4): Supabase (database, authentication), Vercel (hosting), Google (OAuth) and hCaptcha (bot protection). These third parties have their own terms and privacy policies. We are not responsible for issues arising from their services.
The Arkanda! brand, logo, code, design and all intellectual property rights belong to us. They may not be copied, distributed or used in derivative works without permission.
Suggestions, feedback or ideas you send us about the Service may be used by us without any copyright restriction or compensation.
We may update these Terms from time to time. Material changes will be notified within the application, sent via email to registered users and reflected in the "Last updated" date. Material changes provide 30 days' advance notice. If you do not agree with the changes, you may delete your account before they take effect.
If a dispute arises from these Terms, we hope to first resolve it in good faith. Please contact info@arkanda.kitchen.
If resolution cannot be reached, for Türkiye-based users the courts and enforcement offices of Istanbul, Türkiye are competent. For consumer disputes, Consumer Arbitration Committees and Consumer Courts in Türkiye retain their jurisdiction. For users in other countries, Türkiye law applies but mandatory local consumer protection provisions are reserved. For EU users, this does not affect your rights as a consumer to bring proceedings in your country of residence under applicable EU law.
These Terms constitute the entire agreement regarding use of the Service and supersede all prior terms and agreements. If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect. Failure or delay in exercising any right does not constitute a waiver of that right.
